Privacy Statement
Antix Sports processes various types of personal data to organize, facilitate, and carry out its services and activities. We believe it is important that the processing of personal data is carried out in a lawful, careful, secure, and confidential manner. We want to be clear and transparent about what we do—and do not do—with your personal data. In this Privacy Statement, you can read which personal data Antix Sports processes and why we do so. On this page, we explain the applicable legal obligations and responsibilities. Additionally, you will find information regarding your rights concerning your personal data and how you can exercise them.
Legislation
Personal data is processed by us in accordance with the General Data Protection Regulation (GDPR) (Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data). The GDPR has been applicable in the Netherlands since May 25, 2018, and has replaced the previously applicable Personal Data Protection Act.
Data controller
Antix Sports is the data controller within the meaning of the GDPR. This means that the owner or data manager of Antix Sports decides which personal data is processed, for what purpose, and by what means. Antix Sports is responsible for ensuring that personal data is processed in accordance with the GDPR and in a proper and careful manner.
Personal data
Personal data refers to any information that can provide details about an identified or identifiable natural person. Antix Sports processes, among other things, the name, address, and place of residence of all students and companies.
Register of processing activities
Pursuant to Article 30 of the GDPR, Antix Sports maintains a register of all processing activities that take place under our responsibility as a data controller.
Security of personal data
Article 32 of the GDPR requires us to take appropriate technical and organizational measures to prevent the loss or unlawful processing of personal data. The scope of these measures is proportionate to the limited risks of the processing and the nature of the data, insofar as this is possible with current technology, reasonable effort, and at a reasonable cost. We use standard ICT tools with access control to files and folders via username and password. Collected data is stored in Webflow, which runs on Webflow's servers. These comply with GDPR standards. We also use secure server communication (HTTPS/SSL).
Purpose of processing
All personal data processed by Antix Sports is essential for the proper organization and execution of the company's activities. Organizing activities effectively and ensuring a safe and smooth kite lesson experience is always our top priority. To this end, instructors receive concise information about students so they can provide them with the most positive and safe kite experience possible. Communicating about Antix Sports (the brand), promoting our services, and the practical execution of Antix Sports' activities via channels such as social media or email newsletters are part of this objective.
Legal basis for processing
Antix Sports must be able to base the processing of personal data on one of the legal grounds set out in Article 6 of the GDPR. The primary legal basis is Article 6(1)(b) GDPR, as the processing of personal data is necessary for entering into and performing an agreement (i.e., the participant and volunteer agreements). The secondary legal basis is Article 6(1)(f) GDPR, as the processing of personal data is necessary for the purposes of legitimate interests (i.e., communicating about the company, promotion, and the practical execution of activities and services).
Internal management
We maintain a careful and proportionate access and authorization policy. Only a limited number of Antix Sports employees have direct access to the personal data contained in the files. Other Antix Sports employees only receive access to the data they need to perform their own tasks. For example, when scheduling activities, instructors only receive the first names of the participants in their own group.
Website and social media
Antix Sports has its own website, Facebook page, Instagram account, LinkedIn page, and Twitter account. Posts and photos of activities are published here, in which individuals may be recognizable. Where reasonably possible, we ask the people depicted in the photos (or their legal representative) for permission to take the photos. For this reason, we use only first names on social media as much as possible. If you find images on our website or social media accounts in which you or your child are recognizable and you would prefer them to be removed, please feel free to contact us (see Contact). People present at activities as participants, supervisors, volunteers, or bystanders may also take photos themselves or copy publicly posted photos from the Antix Sports website, Facebook page, or Instagram account and distribute them further via their own social media and networking sites. Antix Sports is not responsible for this. However, we do ask our instructors and (parents of) participants via our rules of conduct/house rules to respect the privacy of others present at the lessons when taking and sharing their own photos. The terms and conditions regarding privacy and liability set by the providers of these services apply to visitors and followers of our social media channels.
Personal data retention period
Antix Sports does not store your personal data longer than is necessary for the purpose of the processing (Article 5(1)(e) GDPR). Retention periods vary depending on the type of processing and the purpose. We store the data of our participants who have taken part in kite lessons for up to 2 years after the last registration date or participation. If a participant joins again after 2 years, they will need to provide all information again. Exceptions are made for data subject to a minimum statutory retention period longer than 2 years. For example, financial or payment data related to donations/sponsorships or expense claims, which are subject to a tax obligation, are kept for 7 years in accordance with legal requirements.
